Terms & Conditions
These terms apply to every quotation, order and sale of forklifts, material handling equipment, parts and accessories by M&C Industrial Solution Pte Ltd (UEN 202416056H). Renting equipment, or leasing it to own, is covered by our Rental & Lease to Own Terms & Conditions.

These terms come first
They form part of every quotation we issue and every order accepted from it. Where a customer's purchase order or standard terms say something different, these terms apply unless we have agreed otherwise in writing.

The equipment
The equipment is as described in the quotation. For used or refurbished equipment, the make, model, year of manufacture, serial number and hour-meter reading at handover are recorded on the Delivery Order and the invoice. Specifications and photographs are indicative; the maker may change specifications without notice.

Price and GST
Prices exclude GST, which is charged at the prevailing rate. Standard transport is included where the quotation says so; special transport, lifting, or delivery outside normal working hours is charged separately.

Payment
Payment is as stated in the quotation. Unless credit terms have been agreed in writing, the balance is payable before delivery. Accounts overdue by more than 14 days carry interest at 3% per month on the outstanding balance.

Ownership and risk
The equipment remains our property until the price has been paid in full. Risk passes to the customer on delivery. Until ownership passes, the customer must not sell, pledge or dispose of the equipment, and we may recover it if payment is not made.

Delivery
Lead times are estimates and run from order confirmation and receipt of any deposit. Delivery is to the address stated. The customer provides safe access, level ground and room to unload. Waiting time and failed deliveries are chargeable. We are not liable for delay caused by the maker, shipping, or anything outside our reasonable control.

Warranty
The warranty is as stated in the quotation and runs from the date of delivery. Where we have to repair or replace a part covered by the warranty, we choose whether to repair or replace it, and that is the customer's remedy in full.
The warranty does not cover:
- Wear-and-tear parts and consumables — tyres, forks, filters, brake linings, hoses, oils, battery water
- Accident, misuse, overloading, or use outside the rated capacity or intended application
- Repairs or modifications carried out by anyone we have not authorised
- Equipment that has not been serviced to the maker's schedule
- Batteries and chargers beyond the maker's own warranty

What is not included
- Operator training beyond anything specifically quoted
- Statutory examination and certification after handover
- Insurance
- Fuel, charging, consumables and daily checks

Safety and the law
From handover, the customer is responsible for arranging examination and certification of the equipment by an Authorised Examiner at least once every 12 months, for ensuring that only trained and certified operators use it, and for complying with the Workplace Safety and Health Act and its regulations.

Cancellation
Once we have committed to supply a specific unit — ordered it, imported it, or started refurbishment or fitting work — the order cannot be cancelled, and any deposit is forfeit. Where we are able to cancel without cost, we will refund the deposit less any expense already incurred.

Our liability
We are not liable for loss of profit, loss of production, or any indirect or consequential loss. Nothing in these terms limits our liability for death or personal injury caused by our negligence.

How long a quotation lasts
A quotation is valid for the number of days stated on it, and remains subject to the equipment still being available when the order is placed. Prices assume the site conditions agreed at the time of quoting and may be revised if those conditions change.

Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore have jurisdiction.
