Terms & Conditions

These terms apply to every forklift and material handling equipment rental and lease-to-own quotation, order and agreement between M&C Industrial Solution Pte Ltd (UEN 202416056H) and the customer. Clauses marked lease or rental apply only to that type of agreement. Selling equipment outright is covered by our Sales Terms & Conditions.

  1. These terms come first

    They form part of every quotation we issue and every agreement signed from it. Where a customer's purchase order or standard terms say something different, these terms apply unless we have agreed otherwise in writing.

  2. The equipment

    The equipment is as described in the quotation. For used or refurbished equipment, the make, model, year of manufacture, serial number and hour-meter reading at handover are recorded on the Delivery Order, which forms part of the agreement.

  3. When it starts and how it ends

    The term starts on delivery.

    • Rental — runs for the minimum period quoted, then continues month to month until either side gives one month's written notice.
    • Lease to own — runs for the fixed period quoted and cannot be ended early. The customer may exercise a purchase option instead (clause 13).
  4. Payment

    Payments are monthly in advance. GST at the prevailing rate applies to every sum, including any purchase amount. Payments may not be withheld or set off against any claim. Accounts overdue by more than 14 days carry interest at 3% per month on the outstanding balance.

  5. Deposit

    A deposit is held as security, without interest, and refunded within 30 days of the equipment being returned or the final payment being received, less anything owing to us. Where the quotation states the deposit is a down payment, it counts towards the purchase price and is not refundable.

  6. Ownership and risk

    The equipment remains the property of M&C until every sum due, including any purchase amount, has been paid in full. Risk passes to the customer on delivery. The customer must not sell, sublet, lend, pledge, modify, or move the equipment away from the site stated in the quotation without our written consent.

  7. What is included

    • Scheduled preventive maintenance at the frequency quoted
    • One set of tyres per year
    • Breakdown attendance within one working day (Monday to Friday, 8.30am–5.30pm), for fair wear and tear
  8. What is not included

    • Fuel, charging and electricity
    • Battery topping-up and the operator's daily checks
    • The operator
    • Damage from accident, misuse, overloading or wrong application
    • Tyres beyond the set in clause 7
    • Forks, attachments and accessories not listed in the quotation
    • Cleaning, and any work arising from use beyond the hours in clause 9
  9. How much the equipment may be used

    The rates quoted assume single-shift use of up to 1,000 hours a year. Servicing arising from use beyond that is charged at our prevailing rates. We may read the hour meter on request.

  10. Safety and the law

    While we service the equipment, we arrange for it to be examined and certified by an Authorised Examiner at least once every 12 months, at our cost, and we keep the certificate available to the customer.

    The customer must ensure that only trained and certified operators use the equipment, that it is used in a safe working area, and that the Workplace Safety and Health Act and its regulations are complied with at all times.

  11. Insurance

    We insure the equipment against loss and damage for the term. The customer bears the policy excess, being 1% of the loss subject to a minimum of S$1,000 per incident. The customer is responsible for insuring its own liability for injury or damage arising from the operation of the equipment.

  12. If the equipment is lost or written off

    The customer pays the outstanding payments for the balance of the term plus any purchase amount, less any insurance proceeds actually received by us.

  13. Buying the equipment lease

    On payment of the end-of-term amount stated in the quotation, plus GST, ownership passes to the customer.

    Where the quotation states an early purchase option and the month it may be taken, the customer may exercise it in that month provided all payments are up to date. From the point of purchase the equipment is sold as it stands; ownership passes when funds have cleared, and any remaining warranty is as stated in the quotation.

  14. Returning the equipment rental

    The equipment is returned in the condition it was delivered in, fair wear and tear excepted. Cleaning, missing parts, and damage beyond fair wear and tear are chargeable. We arrange collection and charge it as quoted.

  15. Delivery and the site

    We deliver to the address stated in the quotation. The customer provides safe access, level ground and room to unload. Waiting time and failed deliveries are chargeable. Prices assume the site conditions agreed at the time of quoting and may be revised if those conditions change.

  16. If payments stop

    If a payment is more than 14 days overdue, or the customer becomes insolvent or breaches these terms, we may end the agreement. All outstanding sums fall due immediately, and the customer permits us to enter the site to recover the equipment.

  17. Our liability

    We are not liable for loss of profit, loss of production, or any indirect or consequential loss. Nothing in these terms limits our liability for death or personal injury caused by our negligence.

  18. How long a quotation lasts

    A quotation is valid for the number of days stated on it, and remains subject to the equipment still being available when the order is placed.

  19. Governing law

    These terms are governed by the laws of Singapore, and the courts of Singapore have jurisdiction.
